RECREATIONAL ACTIVITY* WARNING, PARTICIPATION WAIVER AND RELEASE.

*”Recreational activity”: Defined as services supplied for the purpose of, in connection with, or incidental to the pursuit of a recreational activity provided by MML ENT PTY LTD ACN: 623 467 970 T/as Magic Men Live.

IMPORTANT NOTICE TO TICKET HOLDERS: 

By purchasing a ticket and participating in the Magic Men cabaret show (the “Event”), you agree to the terms of this notice, Participation Waiver and Release. This document may affect your legal rights and must be read carefully.

1. Warning and Description of Recreational Activity 
I understand that the Event is a live male cabaret performance involving theatrical elements, music, lighting, and audience interaction. As part of the show, I may be invited on stage while a performer dances in proximity, which may involve physical contact or touching. I acknowledge that this activity is recreational in nature and may involve obvious risks as defined under applicable liability legislation.

2. Voluntary Participation and Assumption of Risk 
I confirm that my participation is voluntary and may occur while under the influence of alcohol. I accept all risks associated with my participation, including those arising from my own intoxication or pre-existing medical conditions, pursuant to the doctrine of Talem qualem (egg shell skull rule). I understand that the Event may involve physical and psychological stimuli that could result in injury or distress.

3. Disclosure of Medical Conditions 
I declare that I have disclosed any relevant pre-existing medical or psychological conditions that may affect my ability to safely participate in the Event. I understand that failure to disclose such conditions may increase the risk of injury and does not limit the effect of this release.

4. Release and Waiver of Liability 
To the fullest extent permitted by law in the jurisdiction where the Event is held—including but not limited to the Civil Liability Act 2002 (NSW), Personal Injuries Proceedings Act 2002 (Qld), Wrongs Act 1958 (Vic), Civil Liability Act 1936 (SA), Civil Liability Act 2002 (WA), Civil Liability Act 2002 (Tas), Civil Law (Wrongs) Act 2002 (ACT), and Personal Injuries (Liabilities and Damages) Act 2003 (NT)—I release and discharge the Event organiser, its employees, contractors, agents, and affiliates (collectively, the “Released Parties”) from any and all liability for personal injury, mental harm, or property damage arising from or in connection with my participation in the Event, whether arising from negligence (including negligent acts or omissions) or otherwise.

New South Wales (NSW) – Civil Liability Act 2002 (NSW), s5M: WARNING: This recreational activity involves a significant risk of physical harm. You participate at your own risk.
Queensland (QLD) – Civil Liability Act 2003 (Qld), s17–19: WARNING: Participation in this recreational activity may expose you to obvious risks of injury. You voluntarily assume these risks.
Victoria (VIC) – Wrongs Act 1958 (Vic), s14–15: WARNING: This recreational activity carries inherent risks of physical and psychological harm. By participating, you accept these risks.
Western Australia (WA) – Civil Liability Act 2002 (WA), s5I–5J: WARNING: You are engaging in a recreational activity that involves obvious risks. No duty of care is owed for harm resulting from those risks.
South Australia (SA) – Civil Liability Act 1936 (SA), s38–39: WARNING: This activity involves risks that may result in injury. You participate at your own risk.
Tasmania (TAS) – Civil Liability Act 2002 (Tas), s19–20: WARNING: Recreational participation may result in physical or mental harm. You accept all associated risks.
Australian Capital Territory (ACT) – Civil Law (Wrongs) Act 2002 (ACT), s94–95: WARNING: This recreational activity involves obvious risks. You accept these risks by participating.
Northern Territory (NT) – Personal Injuries (Liabilities and Damages) Act 2003 (NT), s8–10: WARNING: Participation in this recreational activity involves risks of injury. You accept these risks.

5. Indemnity 
I agree to indemnify and hold harmless the Released Parties against any claims, demands, or proceedings brought by any third party arising out of my conduct during the Event.

6. Alcohol and Capacity 
I confirm that I am of sound mind and not so intoxicated as to be incapable of understanding or consenting to this waiver at the time of execution.

7. Consumer Law and Severability 
Nothing in this waiver limits any rights I may have under the Australian Consumer Law that cannot lawfully be excluded. If any provision of this waiver is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

8. Jurisdiction and Governing Law 
This waiver shall be governed by and construed in accordance with the laws of the state or territory in which the Event is held. Any dispute arising under this waiver shall be subject to the exclusive jurisdiction of the courts of that state or territory.
9. Execution and Binding Effect 

This waiver is executed electronically at the time of ticket purchase and forms part of the terms and conditions of entry. It is binding upon me, my heirs, executors, and assigns.

10. Opt-Out Procedure 
Suppose I do not wish to participate or discuss a relevant medical condition. In that case, I understand that I must notify Event staff prior to entry or participation and that reasonable efforts will be made to accommodate my request, subject to the nature of the Event.

MAGIC MEN CABARET SHOW – TERMS OF PARTICIPATION

By purchasing a ticket and/or attending the Magic Men cabaret show (the “Event”), you agree to the following Terms of Entry. These terms form part of the conditions of sale and entry and are legally binding.
 
1. Participation Waiver and Assumption of Risk 
The Event involves recreational activity, including music, lighting, audience interaction, and potential physical contact with performers. You may be invited on stage to sit in a chair while a male performer dances in proximity. Participation may occur while under the influence of alcohol. You voluntarily assume all risks associated with participation, including physical or psychological injury, distress, or aggravation of pre-existing medical conditions, pursuant to the doctrine of Talem qualem (egg shell skull rule).
 
2. Jurisdiction-Specific Risk Warning 
The following warning is issued pursuant to applicable civil liability legislation in the jurisdiction where the Event is held:
•     NSW – Civil Liability Act 2002 (NSW), s5M: This recreational activity involves a significant risk of physical harm. You participate at your own risk.
•     QLD – Civil Liability Act 2003 (Qld), s17–19: Participation may expose you to obvious risks of injury. You voluntarily assume these risks.
•     VIC – Wrongs Act 1958 (Vic), s14–15: This activity carries inherent risks of physical and psychological harm. You accept these risks.
•     WA – Civil Liability Act 2002 (WA), s5I–5J: You are engaging in a recreational activity involving obvious risks. No duty of care is owed for harm resulting from those risks.

3. Medical Disclosure 
You declare that you have disclosed any relevant medical or psychological conditions that may affect your ability to safely participate. Failure to disclose does not limit the effect of this waiver.
 
4. Release and Indemnity 
To the fullest extent permitted by law, you release and discharge the Event organiser and its affiliates from any liability for personal injury, mental harm, or property damage arising from your participation, whether caused by negligence or otherwise. You agree to indemnify the organiser against any claims arising from your conduct during the Event.
 
5. Behavioural Standards Policy 
The organiser reserves the right to refuse entry or eject any attendee for disruptive, aggressive, unsafe, or inappropriate behaviour. No refunds will be issued for ejection due to breach of these standards.
 
6. Photography and Media Consent 
You consent to being photographed, filmed, or recorded during the Event. You grant the organiser the right to use your image, likeness, voice, and performance for promotional, marketing, and commercial purposes in any media, in perpetuity, without compensation. If you do not wish to be photographed or filmed, you must notify staff prior to entry. You may withdraw consent at any time by contacting the organiser; reasonable efforts will be made to exclude your image from future use.
 
7. Privacy and Data Collection 
Personal information collected during ticketing or attendance may be used for operational, promotional, and marketing purposes in accordance with the organiser’s privacy policy. Your data may be disclosed to third-party platforms, including those hosted outside Australia. For details, refer to the organiser’s privacy policy or contact [insert contact details].
 
8. Public Health and Safety 
You acknowledge that attendance may carry public health risks. The organiser complies with all applicable health directives. You waive any claims arising from illness contracted at the Event.
 
12. Governing Law 
These Terms of Entry are governed by the laws of the state or territory in which the Event is held. Any dispute shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
 
PHOTOGRAPHY AND MEDIA CONSENT
The Event Organiser
By attending the Magic Men Live cabaret show (the “Event”) organised by MML ENT PTY LTD ACN: 623 467 970 T/as Magic Men Live, I acknowledge and agree:

Consent to Photography and Filming 
I understand that the Event may be photographed, filmed, or otherwise recorded by the Event organiser or its authorised representatives. This may include images, video, or audio recordings of audience members, including myself, whether individually or in groups.

Use of Image and Likeness 
I grant the Event organiser and its affiliates the irrevocable right to use, reproduce, publish, broadcast, distribute, and otherwise exploit my image, likeness, voice, and performance captured during the Event for promotional, marketing, advertising, archival, or commercial purposes, in any media format (including social media, print, digital, and broadcast) and in perpetuity, without compensation or further notice.

No Expectation of Privacy 
I acknowledge that the Event is held in a public or semi-public setting and that I have no reasonable expectation of privacy regarding my appearance at the Event.

Waiver of Claims 
To the fullest extent permitted by law, I waive any right to inspect or approve the finished product or any use to which my image or likeness may be applied. I release the Event organiser and its affiliates from any claims, demands, or causes of action arising out of or in connection with the use of such media.

Opt-Out Procedure 
If I do not wish to be photographed or filmed, I understand that I must notify Event staff prior to entry and that reasonable efforts will be made to accommodate my request, subject to the nature of the Event.

TERMS AND CONDITIONS FUNCTIONS, PACKAGES AND THE SHOWS

Magic Men wishes to advise you of the following Terms & Conditions concerning our cabaret show, functions held at our venues, the hiring of a Private Stripper or a topless waiter/s. Guests must be over the age of 18 years old and must be able to provide I.D to guarantee entry.

A deposit is required to secure a booking o a reservation for your group. The final numbers for your group are not required until the week of the event. On the Monday of the week of the event is the only time when your final numbers are expected (we require you to commit your exact number on the week of the event). The final outstanding amount can be paid on the night at the door or 1 week prior if you would like to do a bank transfer/EFT payment.

All packages and private lounges are subject to availability. Topless waiters are provided for the entire duration of time you’re in the private lounge and are assigned according to the size of your group. Extras may be requested and we are happy to customise a package suited to you however additional costs may apply.

A 3% surcharge applies for all Visa and Mastercard credit card payments.

 

TERMS AND CONDITIONS FOR HOME VISIT PERFORMERS AND WAITERS

Terms and Conditions for booking our entertainers.

You must be over the age of 18 to make a booking and hire our entertainment. We aim to provide quality entertainment to our customers, however, we must first and foremost ensure a safe work environment for our girls/guys. Upon booking your entertainment you are agreeing to be bound by the following terms and conditions. You cannot touch our staff inappropriately. Our strippers may allow guided touching ie.thighs, buttocks, or breasts/chest. This choice is up to the individual entertainer and you may only touch the areas the stripper directs you to touch during the entertainment.

Please note as the performers are highly booked out on Fridays & Saturdays the time you book will always be approximate. You cannot be obscene or insult the performers in any way. We will not provide x-rated shows to functions where men are present. You may be required to provide a room for the entertainer to change into his/her costume. If you are planning your entertainer to be a surprise, please let us know when booking. We will organise the performer to be in costume upon arrival.

You are required to pay your entertainer in cash when they arrive before the show commences.

 

Refund Policy

REFUND POLICY for functions booked or packages booked

1. The hirer may cancel their booking within 7 days of payment of the deposit, and receive their deposit back in full less the administration fee (20% of the deposit).

2. If the hirer cancels their booking after 7 days of booking, their deposit will not be refunded.

3. If the hirer cancels their booking within 14 days before the date, the full hire amount is to be paid by the hirer.

4. If the hirer books within 14 days of the booking date, then cancel, the hirer will forfeit the deposit in full.

For late payment, a penalty fee may apply.

Before contacting us to cancel your package because your event is not going ahead or the party is cancelled, please consider a change of date as a way to keep your deposit and use it for a girls night out on another date. We allow one free change to your booking date/package. Any subsequent changes after this will incur a further deposit equivalent to the one initially made to keep the booking still.
Administration Fee Applies to Cancellations and is usually calculated at 20% of the deposit made.

 

REFUND POLICY for tickets booked to the stage show

Purchased tickets for the stage show are non-refundable, non -redeemable and non-transferable to another person. Please select the date carefully and contact us if you have any enquiries. Unless the event you have purchased a ticket for has been cancelled or rescheduled, or there are legal requirements that provide otherwise (including those of the Australian Consumer Law), tickets cannot be exchanged or refunded. If an event is rescheduled, you will be offered equivalent seats at the rescheduled event. If you are unable to attend the rescheduled event or an event is cancelled entirely, you are entitled to a refund of the face value of the tickets and the per ticket booking fee.

 

REFUND POLICY FOR HOME VISIT PERFORMERS AND WAITERS

If you have paid your deposit, and it is confirmed by our staff member. If you decide to cancel your booking for any reason such as “change of mind” or “event is not going ahead” after paying your deposit, you will forfeit your deposit. We allow one free change to your booking date/package, this is to help you keep the initial deposit you have made and use it for another occasion and time in the future. Any subsequent changes after this will incur a further deposit equivalent to the one initially made to keep the booking still.

Please note, we understand that unforeseeable events (specifically deaths, wedding cancelled, sickness and unforeseen accidents) do occur, with that in mind we do allow one change to the booking free of charge. Any changes after, are subject to what we have left and also incurs additional fee equivalent to the deposit to still keep the booking. This change must be done 1. in writing and 2. at least 1 week before the event.
